On June 9, 2023, the Scientific Committee on Consumer Safety (SCCS) published its Final Opinion on the safety of Salicylic Acid as used in non-sprayable cosmetic products.

On 9 June 2023, the Scientific Committee on Consumer Safety (SCCS) published its final Opinion on the safety of Salicylic Acid (CAS 69-72-7, EC 200-712-3). The SCCS adopted this Opinion during the plenary meeting on 6-7 June 2023.

BACKGROUND

Salicylic Acid (CAS 69-72-7, EC 200-712-3) with the chemical name ‘benzoic acid, 2-hydroxy’ is used in cosmetic products as denaturant, hair and skin conditioning agent, exfoliant/keratolytic, anti-sebum agent, anti-dandruff/anti-seborrheic agent and as preservative.

Salicylic Acid has been subject to a safety evaluation by the Scientific Committee on Cosmetics and Non-Food Products (SCCNFP) in 2002 and by the SCCS in 2018. In particular, the last SCCS assessment was performed in view of the classification of Salicylic Acid as a CMR 2 (Repr. 2) substance under Regulation (EC) 1272/2008 (CLP) and in accordance with the provisions of Article 15 of the Cosmetics Regulation No. 1223/2009. Salicylic Acid is currently regulated under Annex III (entry 98) and Annex V (entry 3), with specific maximum concentrations and conditions of use.

Upon the European Commission’s call for data, stakeholders submitted scientific evidence to demonstrate the safety of Salicylic acid in cosmetic products. The Commission requested the SCCS to carry out a safety assessment on Salicylic Acid in view of the information provided, taking into account the maximum concentration and relevant provisions for different categories of cosmetic products listed in Annex III and Annex V to the Cosmetics Regulation No. 1223/2009, as well as the intention of the industry to use Salicylic Acid in oral products.

WHAT’S NEW?

In light of the data provided and considering the potential endocrine-disrupting properties of Salicylic Acid, the SCCS is of the opinion that:

  1. Salicylic Acid is safe when used as preservative at a concentration of 0.5% in cosmetic products, considering its current restrictions in place.
  2. Salicylic Acid is an eye irritant with the potential to cause serious damage to the eye.

The SCCS Opinion is not applicable to any sprayable product (including mouth spray) that may lead to exposure of end-user’s lungs by inhalation.
