Regulation (EU) 2022/1176 amends Regulation (EC) No 1223/2009, restricting the use of Benzophenone-3 and Octocrylene as UV filters in cosmetic products.

On July 7, 2022, the European Commission published the Regulation (EU) 2022/1176, amending the EU Cosmetics Regulation as regards the use of certain UV filter in cosmetic products. The use of Octocrylene and Benzophenone-3 was restricted, following the opinion published by the SCCS published in March 2021.

Considering these SCCS opinion, the European Commission concluded that there is a potential risk to human health arising from the use of these ingredients as UV filters in the concentrations currently allowed and that their use should be restricted to the maximum concentration proposed by the SCCS.

Entries 4 and 10 of Annex VI to Cosmetics Regulation were replaced by the following:

Cosmetic products containing Octocrylene or Benzophenone-3 and complying with the restrictions set out in the European Cosmetics Regulation as applicable on 27 July 2022 may be placed on the market until 28 January 2023 and be made available on the market (sell-off) until 28 July 2023.

SCCS Revision of the Scientific Opinion on Vitamin A

The Scientific Committee on Consumer Safety has issued a final version of the Scientific Opinion on Vitamin A, concluding that exposure to Vitamin A derived from cosmetics can be a concern for higher exposure consumers, and since cosmetics alone do not exceed the upper limit the SCCS cannot suggest maximum concentration limits that take into account contributions from other sources.

The Commission Delegated Regulation (EU) 2022/692 includes new or updated classification for 12 chemicals that may be used as cosmetic ingredients. Seven out of these 12 are now classified as carcinogenic, mutagenic or toxic to reproduction (CMR) and are banned from cosmetic products marketed in the EU.
