UK OPSS calls for data on the safety of cosmetic ingredients

On 15 August 2023, the Office for Product Safety and Standards (OPSS – the UK regulator for cosmetic products) issued calls for data on the safety of cosmetic ingredients to investigate any suspected endocrine disrupting properties and safety whe used as nanomaterials.

On 15 August 2023, the UK Office for Product Safety and Standards (OPSS) launched two calls for data on cosmetic ingredients with suspected endocrine disrupting properties and cosmetic ingredients used as nanomaterials.

Ingredients to be evaluated in cosmetic products due to their suspected endocrine disrupting properties:

Triclosan (CAS 3380-34-5)
Triclocarban (CAS 101-20-2)
4-Methylbenzylidene camphor (4-MBC) (CAS 36861-47-9 / 38102-62-4)
Salicylic Acid (CAS 69-72-7)
Butylparaben (CAS 94-26-8)
Methylparaben (CAS 99-76-3)

The deadline for submission of data is 15 December 2023.

Nanomaterials to be safety assessed in cosmetic products:

Platinum
Copper
Silver
Gold, colloidal gold, gold thioethylamino hyaluronic acid
Silica, hydrated silica, silica silylate, silica dimethyl silylate
Lithium magnesium sodium silicate
Hydroxyapatite

The deadline for submission of data for silica, hydrated silica, silica silylate, and silica dimethyl silylate is 27 June 2025. For all other substances, the deadline is 22 December 2023.

French labelling requirement for leave-on products containing Phenoxyethanol repealed

Ingredients: PHENOXYETHANOL

The EU Court of Justice repealed the French requirement for the labelling of the precautionary measurement “Not to be used on the nappy-skin area of children under 3 years of age” on leave-on cosmetic products containing Phenoxyethanol. Therefore, the labelling restriction related to Phenoxyethanol is officially not mandatory for products imported into France.

Update on the classification and labelling of Titanium Dioxide in powder form

Ingredients: TITANIUM DIOXIDE

The EU General Court annuls the Commission Delegated Regulation of 2019 in so far as it concerns the harmonised classification and labelling of Titanium Dioxide as a carcinogenic substance by inhalation in certain powder forms.

Butylphenyl Methylpropional (Lilial) ban in cosmetics comes into force in Great Britain

Ingredients: BUTYLPHENYL METHYLPROPIONAL

Date of application: 15/12/2022

Due to its classification as toxic to reproduction, Butylphenyl Methylpropional is prohibited in cosmetic products placed in the Great Britain market as of December 15, 2022.

SCCS Final Opinion on the Safety of Triclocarban and Triclosan

Ingredients: TRICLOCARBAN and TRICLOSAN

During the plenary meeting on 24-25 October 2022, the Scientific Committee on Consumer Safety (SCCS) presented its final opinion on the safety of Triclocarban and Triclosan as substances with potential endocrine disrupting properties in cosmetic products.

Italy and France – Environmental Labelling of Cosmetic Products

Although the European Cosmetics Regulation is applicable to every cosmetic product made available in the European Union market, some national legislations may also apply. Environmental regulations in Italy and France specify mandatory labelling requirements applicable to packaged products marketed in these countries.

Date of application: 01/01/2023, with a transition period until 09/03/2023 for packaging produced or imported before 09/09/2022.

The Loi relative à la lute contre le gaspillage et a l’économie circulaire (Anti-Waste for a circular economy) has come officially into force in France in 2020. From January 2023 the requirements of the law became mandatory, including specific symbols on the packaging or labelling of cosmetic products.
